Terms of Service

By downloading, installing, or using the PetFiles mobile application or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and PetFiles. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

PetFiles is intended for personal, non-commercial use in connection with the care and management of your pets.

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration

• Maintain and promptly update your account information

• Keep your account credentials confidential

• Notify us immediately of any unauthorized use of your account

• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

Free Tier (PetFiles Connect): The Service includes a free tier ("PetFiles Connect") that provides access to community features including lost & found, adoption, and rehoming listings. The free tier does not include pet record management, health tracking, or document storage.

Paid Subscriptions: PetFiles offers three paid subscription plans — Solo (1 pet), Duo (up to 2 pets), and Family (unlimited pets) — billed on a monthly or annual basis.

Billing: Subscriptions are billed in advance. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation: You may cancel your subscription at any time through the app or by contacting support. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

Price Changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

In-App Purchases (Apple App Store): If you purchase a subscription through the Apple App Store, the purchase is subject to Apple's payment terms and conditions. Apple's refund policy applies to such purchases.

You retain ownership of all content you upload or create through the Service ("User Content"), including pet photos, medical records, documents, and community listings.

By uploading User Content, you grant PetFiles a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of operating and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to all User Content you submit

• Your User Content does not violate any third-party rights

• Your User Content complies with these Terms and all applicable laws

We do not claim ownership of your User Content and will not share it with third parties except as described in our Privacy Policy.

PetFiles Connect allows users to post public listings for lost pets, found pets, pets available for adoption, and pets in need of rehoming.

When posting a community listing, you agree that:

• All information provided is accurate and truthful to the best of your knowledge

• You will not post listings for commercial breeding or sale of pets for profit

• You will not include content that is offensive, misleading, or harmful

• Contact information you include may be visible to other users

• You will mark listings as resolved when no longer applicable

PetFiles does not verify the accuracy of listings and is not responsible for outcomes arising from connections made through PetFiles Connect. Use your own judgment and exercise caution when meeting unknown individuals in connection with a listing.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations

• Post false, misleading, or fraudulent content

• Harass, abuse, or harm other users

• Attempt to gain unauthorized access to any part of the Service

• Use automated means (bots, scrapers, etc.) to access or collect data from the Service

• Reverse engineer, decompile, or disassemble any part of the Service

• Use the Service to transmit malware, spam, or other harmful code

• Impersonate any person or entity

• Use the Service for commercial solicitation without our written consent

• Circumvent any access controls or security features of the Service

PetFiles is a pet record management and organization tool. It is not a substitute for professional veterinary advice, diagnosis, or treatment.

Information stored in PetFiles — including health records, vaccine logs, and medication tracking — is provided for organizational purposes only. Always seek the advice of a qualified veterinarian with any questions you may have regarding your pet's health or medical condition.

The AI assistant ("Tolu") provides general informational responses and is not a licensed veterinarian. Do not rely on AI-generated responses for emergency situations or medical decisions.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and the "PetFiles" and "Tolu" names and branding — are owned by PetFiles and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service or its content.

You may delete your account at any time through Settings → Delete Account. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

Sections of these Terms that by their nature should survive termination shall survive, including sections on intellectual property, disclaimers, limitations of liability, and dispute resolution.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any data stored through the Service will be free from loss, corruption, or unauthorized access.

You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETFILES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

If you download PetFiles through the Apple App Store, the following additional terms apply:

• These Terms are between you and PetFiles only, not Apple, Inc. ("Apple")

• Apple has no obligation to provide maintenance or support services for the app

• In the event of any failure of the app to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.

• Apple is not responsible for addressing any claims relating to the app or your use of it

• In the event of any third-party claim that the app infringes intellectual property rights, Apple is not responsible for the investigation or settlement of such claims

• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by sending an email notification or displaying a notice within the app.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
